If you’re in a Florida car accident, and you’re from another state, the parties that are responsible to pay your medical bills may be different.
Your Out of State Medpay or PIP May Cover You
Most states outside of Florida don’t have Personal Injury Protection (“PIP”) insurance on cars like Florida does. In most states, car owners can elect to purchase medical payments (“Medpay”) insurance, which will pay 100% of your medical bills up to a certain limit.
In many situations, Medpay will cover an out of state driver or passenger who is hurt in Florida. This is true even if they aren’t in their own car at the time of the accident.
If your bills are paid under Medpay coverage in an auto policy, the Medpay insurer may have a right of to get paid back from your personal injury settlement.
Warning! Don’t automatically pay the Medpay insurer without having a complete understanding of the out of state law.
The Medpay reimbursement amount may be negotiable. Sometimes you may be able to get it waived.
A Medpay insurer is often required to reduce its reimbursement claim by your attorney’s fees and costs. This is 1 of 12 reasons to hire a lawyer.
If You Don’t Have PIP or Medpay in Your Out of State Insurance Policy, Host Car’s PIP Covers You
Sometimes someone who lives out of state won’t have PIP or Medpay on his or her car insurance policy, and/or he/she isn’t covered through a resident relative’s auto insurance policy.
If this is the case, the PIP insurance of the car that you’re an occupant in (the “host car”) while in Florida should cover you.
Need to Treat Within 14 Days for Florida PIP to Cover You
You have 14 days to get medical treatment in order to qualify for Florida PIP.
Even if You Have Out of State PIP/Medpay, Host Car May Still Cover You
Even if your out of state Medpay or PIP insurance covers you, the host car’s PIP may still cover you. Read the insurance policies for each car and the out of state law.
The host car’s PIP should cover a passenger irrespective of the passenger’s residency.
I don’t know if the out of state car insurance policy would provide coverage, or whether it pays before Florida PIP.
Make a Claim With Florida and Out of State Car Insurer
I’d make a claim with the Florida auto insurer and the out of state auto insurer and let them give me a written response.
Give Both Claim Numbers to All Medical Providers
I’d give the car insurance claim number/info to all of my medical providers so that the medical provider doesn’t later argue that I’m responsible for the bill if one of the insurers argues that the time for a medical provider to submit a bill to PIP/Medpay has passed.
Out of State Medpay May Not Cover You If You’re on a Business Trip in Florida When the Accident Happens
If you’re injured while on a business trip in Florida, and you get workers’ compensation benefits, your Medpay from your personal auto insurance may not cover you.
This is because many out of state auto insurance policies say that you’re not entitled to Medpay if you get workers compensation benefits.
Out of State UM May or May Not Cover Future Medical Bills and Future Lost Wages Payable by Workers’ Compensation
If you’re covered by out of state UM insurance, it may or may not pay for future medical bills and future lost wages. It depends on the out of state’s UM insurance law.
