I’ve written a lot about personal injury claims with State Farm in Florida. Here, I focus on car accident claims with State Farm where the claimed injury is a herniated disc.
Actual Case (My Case): $26,000 Settlement for a young woman who was in a car accident and was diagnosed with a herniated disc. The at fault car had State Farm Insurance.
Actual Case (My Case): $25,000 Settlement for a young woman who was in a car accident and was diagnosed with a herniated disc. The at fault car had State Farm Insurance.
My actual case: $17,000 Settlement for a lady in her early 20’s after another driver rear ended her. She claimed the crash caused two herniated discs.
Learn more about this $17,000 Settlement for herniated discs from this Miami-Dade County, Florida car crash. State Farm and Liberty Mutual insured the negligent driver and car owner.
In Florida, a car owner is liable for a permissive driver’s negligence.
My actual case: $14,100 Settlement for a man in his 40’s who was diagnosed with a herniated disc after he was rear-ended by a drunk driver insured. A local insurance company insured the DUI driver.
The local insurer paid $10,000 of the settlement. State Farm paid $4,100 under my client’s underinsured motorist coverage in his auto insurance policy. This is one of my many settlements with State Farm Auto Insurance Company.
Driver Gets $12,500 for Herniated Disc; State Farm Pays $10,000
Maria (not real name) was driving her car in South Miami. A driver crashed into her. The other driver got a ticket for careless driving.
State Farm insured the other driver. Maria didn’t take an ambulance to the hospital.
She drove herself to the hospital. She complained of neck, upper back, shoulder pain.
She then treated for a couple of months with a chiropractor, where she received therapy for her injuries.
She had an MRI of her neck (cervical spine). It showed straightening of the cervical spine suggesting muscle spasm.
At C6-C7, there was a posterolateral disk herniation. Neither the radiologist nor the chiropractor stated the size of the disc herniation.
An MRI of her thoracic spine showed 5 annular disk bulges at T7-T8, T8-T9, T9-T10, T11-T12, and T12-L1. Like most clients with a herniated disc, she did not want epidural steroid injections or neck surgery.
Lady Wins $134,600 Against Driver Insured With State Farm
This is not my case. Jessica Guillen sued a driver insured with State Farm. She claimed that the car accident caused her cervical and lumbar disc bulges and herniations.
She treated with a pain management doctor, who recommended future injection therapy. His opinion was that she would likely need surgery in the future.
State Farm’s medical expert said that the diagnostic results (likely MRIs) showed that Jessica’s spine had degenerative conditions that weren’t related to the auto accident.
A jury awarded her $134,600. $67,600 of that amount was for her pain and suffering.
The verdict was on 2/25/2014. The case is Jessica Guillen v. Maupin.
