Who is Insured under Florida Uninsured Motorist Insurance?

Car front end damage Florida Statute 627.727 states that uninsured motorist (UM) coverage covers the named insured, the named insured’s spouse, and resident relatives.

Example #1

John is a named insured in an auto insurance policy which provides UM coverage.  He is therefore entitled to UM coverage.

Example #2

John is a named insured in an auto insurance policy which provides UM coverage.  John is married to Martha.  Martha is the named insured’s spouse, therefore entitled to UM coverage.

Example #3

John is a named insured in an auto insurance policy which provides UM coverage.  Brian is a John’s brother and he lives with John.  Therefore, John’s UM coverage extends to Brian because they resident relatives.

Example #4

John is a named insured in an auto insurance policy which provides UM coverage.  John is married to Martha.  Marcel is Martha’s brother and Marcel lives with John.   Therefore, John’s UM coverage extends to Marcel because Marcel is a resident relative of Martha, the named insured’s spouse.

1. UM coverage also protects permissive drivers and passengers of the insured vehicle.

Example #5 – Permissive Operator

John is a named insured in an auto insurance policy which provides UM coverage.  He lets Juan borrow his car.  Because Juan is driving John’s car with John’s permission, John’s UM coverage applies to Juan.

Example #6 – Permissive Occupant

John is a named insured in an auto insurance policy which provides UM coverage.  He lets Juan borrow his car.  Juan invites Michelle for a ride.  Because Michelle is in the car with permission, John’s UM coverage applies to Michelle.
