Any motor vehicle that is specifically insured, registered, or garaged in Florida, that has an insurance policy that provides bodily injury coverage must have uninsured motorist coverage, unless the named insured in the policy rejects the coverage. Florida Statute 627.727(1).
Example
You have a car that is insured in Florida. You are the named insured. You have it insured with $10,000 in liability coverage. Because you have liability insurance coverage, your policy automatically gives you amount of uninsured motorist coverage limits equal to the bodily injury limits, unless you rejected – or selected lower UM limits – the uninsured motorist coverage in writing.
Insurance companies only have to include uninsured motorist (UM) coverage for policies that give primary liability insurance for motor vehicles that are specifically insured or identified. UM coverage does not need to be offered for an insurance policy providing excess coverage.
Example
You own a business and you have 15 trucks that your employees use. Your insurance policy for this fleet of trucks does not list the insured vehicles. UM covered does not need to be offered because the vehicles are not specifically insured or identified. If your policy providing excess coverage, UM does not need to be offered.
