Driver Gets $5,000 Settlement for 2 Small Scars to Knee from Car Accident

Adam (not real name) got a $5,000 settlement after another car T-boned the car that he was driving.  The crash happened in an intersection.

United Automobile Insurance Company insured the driver who the officer said failed to stop at a flashing red light.

Case Settles Before a Lawsuit

This case was settled before a lawsuit, which kept my attorney’s fees and costs down.

Adam was driving a car near Westchester, Miami-Dade County, Florida.  Adam was driving vehicle #2 in the diagram above.

Officer Says Other Driver Ran the Red Flashing Light

The crash report said that the driver of vehicle #1, Alex, ran a red flashing light.  However, the officer did not give Alex a ticket.

This Was a Hard Impact

Adam was driving his dad’s car.  (To keep it simple, I’ll refer to this car as Adam’s car.)

Below is a photo of the damage to Adam’s car.

As you can see from the photo above, the impact was hard.  It caused Adam’s vehicle to spin out of control. The airbags deployed.

Adam’s car was towed from the scene.  GEICO insured Adam.  GEICO inspected Adam’s car.

GEICO prepared a property damage estimate showing $12,314 in damage to his car. The following photographs were taken at the scene.

Adam Suffered Bruises and Cuts to His Knee, and Abrasions to His Hands

Adam recalled being in shock and feeling dizzy after the impact. Adam suffered contusions (bruises) to his forearms, elbows and lacerations (cuts) to his knee.

He also had abrasions (cuts) to his hands.  Adam took photos showing his bloody knee and top portion of his lower leg.

I sent these photos to United Auto Insurance.

Adam’s Sister Drove Him to the Hospital

After the crash, Adam’s sister drove him to Baptist Hospital.  The doctor examined him and said that he had tenderness, swelling and bruising (ecchymosis) in the right forearm.

The exam of the left knee showed that he had tenderness and swelling with multiple abrasions.

Adam’s wounds were cleaned using a high pressure irrigation system.  They applied antibiotic ointments.

Clean bulky dressings consisting of adaptic and 4×4 gauze were applied. He was then taken to the radiology department for x-rays of the knee, forearm and elbow.

He didn’t have any fractures.  Due to the multiple abrasions, Adam got a Tetanus injection. His pain level was recorded as a five on a scale from 1-10.

Later, upon release from the hospital, Adam was told to apply ice for 15 minutes four times a day for two days to help bring down the swelling.

He was also instructed to keep his wounds clean and to apply Bacitracin twice daily. He was instructed to keep the affected areas elevated and not to work for two days.

Adam was also prescribed Ibuprofen 800 mg tablets to take every 8 hours for the pain for 30 days.  He was told to follow up with his doctor and an orthopedic surgeon.

I sent the hospital records and bills to United Auto.

Adam Wanted to Drop His Claim

After Adam hired me, he later told us that he didn’t want to continue with his claim.  I assume that he thought he didn’t have a good case because he only had 1 medical visit (the hospital).

He then reconsidered, and let us to continue with his claim.

I Claimed that Adam Had Permanent Scars to Knee

As a result of the crash, I claimed that Adam is left with permanent scars on his knee.  Some recent photos of the scars are at the top of this article.

Anthony’s Car Had PIP Insurance With GEICO

At the time of the incident, the car that Anthony was driving had PIP insurance through GEICO.  Adam’s dad owned the car.

Adam didn’t own a car.  Since Adam lived with his father at the time of the accident, he was entitled to PIP benefits.

GEICO’s PIP paid most of Adam’s medical bills from the hospital.  We requested that GEICO give us a copy of their PIP payout log.

We sent the PIP log to United Auto.

Adam’s case settled for $5,000 with United Auto Insurance.  Adam was very happy with the result.  Especially since he wanted to drop his claim.
