Jury instruction 601.2 speaks to the believability of witnesses in Florida civil cases.
It says that jurors can evaluate the believability of any witness and the weight they will give to the witnesses’ testimony.
The injured person is one of the many witnesses in Florida injury case. Jurors may properly consider the:
- Demeanor of the witness
- Frankness or lack of frankness of the witness
- The intelligence of the witness
- Any interest the witness may have in the outcome of the case
- The means and opportunity the witness had to know the facts about which the witness testified
- The ability of the witness to remember the matters about which the witness testified
- And the reasonableness of the testimony of the witness, considered in the light of all the evidence in the case and in the light of his or her own experience and common sense.
Claims adjusters look at these factors in personal injury cases. A claims adjuster is taking notes in every phone call with him or her.

Tip: There are certain times where you may need to send documents via certified mail to 21st Century. Situations where you should send the document by certified mail are primarily where you are:
- Insured under a 21st Century policy with Medical Payments (“Medpay”) Coverage
- Insured under a 21st Century policy with Florida uninsured motorist (UM) coverage and you have a claim for UM damages.
If you settle a Florida injury case with a 3rd party liability insurer, you want to use Florida law to pay 21st Century as little, if anything, as possible for reimbursement of Medpay benefits.
Sending a Medpay subrogation letter via certified mail may help you achieve this goal. You may be giving up valuable rights (money) if you do not send certain letters to 21st Century via certified mail.
You do not want to blow your uninsured motorist injury benefits.
Is 21st Century a good insurer for paying Florida person injury claims?
21st Century earns a terrible rating for fairly paying Florida injury claims. Whether via email, phone, social media or the web, I speak to Florida accident lawyers every day.
I do not know any lawyers who disagree that 21st Century is terrible at paying Florida injury claims.
This means that most of the time, you should expect 21st Century to offer an amount that is below the fair value of the injury claim. They will most likely offer less than the full value of the pain and suffering component of a case.
This means that you are more likely to need to sue 21st Century’s insured to get the fair value of your injury case. You may be less likely to have to sue them to get fair value if your damages exceed their insured’s policy limits.
This is because they do not want to get sued for bad faith and face excess exposure. 21st Century’s bad reputation is slightly surprising because they are part of Farmers Insurance Group, which is part of Zurich American Insurance Company.
Zurich is above average when it comes to paying Florida personal injury claims. You would think that 21st Century would follow the lead of its “main parent” company, Zurich, and pay claims above average.
Unfortunately, for people who are hurt in accidents involving 21st Century, this is not the case.

21st Century operates under a few different names in Florida.
21st Century Centennial Insurance Company
21st Century Centennial Insurance Company is the largest of its companies for Florida private passenger auto.
Surprisingly, they did not have any consumer complaints. This is a good sign. However, I still believe that still have a terrible reputation at paying Florida injury claims.
